1.  Introduction and Scope

These Website Terms of Use (“Website Terms”) govern access to and browsing of the Fingpay website located at https://www.fingpay.co.in (the “Website”), operated by Tapits Technologies Pvt. Ltd. (“Fingpay”, “we”, “us”, or “our”), a company incorporated under the Companies Act, 2013 (CIN: U72900MP2016PTC040639), authorised by the Reserve Bank of India as a Payment Aggregator, and headquartered at 20 Dhenu Market, Indore 452003, Madhya Pradesh, India.

These Website Terms apply solely to the Website as an informational and access interface. They govern any person who accesses or browses the Website, regardless of whether that person is a registered user, a prospective partner, or a first-time visitor. The use of Fingpay’s services, products, APIs, SDKs, and payment platform is governed separately by Fingpay’s Terms and Conditions, which constitute a distinct legal agreement.

By accessing the Website in any manner — including browsing, reading, downloading content, or submitting any form — you confirm that you have read, understood, and agree to be bound by these Website Terms. If you do not agree to these Website Terms, you must immediately discontinue access to the Website.

Access to the Website is provided on a limited, non-exclusive, revocable, and non-transferable basis solely for lawful purposes and in accordance with these Website Terms. No right, title, or interest in the Website is transferred to you by virtue of access.

  • restrict, suspend, or terminate access to the Website or any part thereof for any reason, including scheduled or emergency maintenance, security incidents, system upgrades, or compliance with any regulatory requirement or court order;

  • impose conditions or requirements on access to particular sections of the Website, including registration, verification, or acceptance of additional terms.

Fingpay does not guarantee that the Website, or any content on it, will be accessible at all times or from all locations. Access may be blocked or unavailable in certain jurisdictions due to regulatory restrictions or technical limitations.

 

3.  Website Availability and Downtime

Fingpay does not warrant or guarantee that the Website will be available on a continuous, uninterrupted, or error-free basis. The Website may be temporarily unavailable due to:

  • scheduled maintenance, upgrades, or technical modifications;
  • unplanned outages arising from hardware failure, software defects, network disruptions, or third-party service issues;
  • security incidents, vulnerability patching, or infrastructure migration; or
  • any directive, order, or requirement from a regulatory authority, law enforcement agency, or court.

Fingpay reserves the right to take the Website offline, in whole or in part, at any time and for any duration as Fingpay deems necessary. Fingpay will endeavour to provide advance notice of scheduled maintenance through available channels where reasonably practicable, but is not obligated to do so.

Fingpay shall not be liable for any loss, damage, cost, or inconvenience — whether direct, indirect, or consequential — arising from the Website being unavailable, inaccessible, or performing below expectation at any time.

 

4.  Accuracy of Website Content

All content published on the Website — including product descriptions, feature lists, pricing indications, technology overviews, news items, press releases, blog posts, case studies, partner references, and certification claims — is provided for general informational purposes only.

Fingpay makes no representation or warranty, express or implied, as to the accuracy, completeness, reliability, currency, or fitness for any particular purpose of any content on the Website. Website content may be amended, updated, removed, or replaced at any time without notice.

Nothing contained on the Website shall constitute, or be construed as, a legally binding offer, proposal, commitment, or guarantee of any product, service, pricing, or feature unless such terms are expressly set out in a written agreement duly executed between Fingpay and the relevant party. In the event of any conflict between Website content and the terms of a signed agreement, the signed agreement shall prevail.

5.  Prohibited Website Conduct

In addition to the general prohibitions applicable to all Platform users (as further described in Section 9 of Fingpay’s Terms and Conditions), the following conduct is strictly prohibited in connection with the Website specifically:

  • scraping, crawling, harvesting, or extracting data from the Website through automated means, bots, spiders, scripts, or any other tool not expressly authorised by Fingpay;
  • probing, scanning, testing, or attempting to assess the vulnerability of the Website or its underlying infrastructure, servers, databases, or network components;
  • overloading, flooding, or disrupting the Website through denial-of-service attacks, distributed denial-of-service attacks, or any method designed to degrade Website performance or availability;
  • injecting malicious code, viruses, Trojans, worms, ransomware, spyware, or any other harmful or disruptive material into the Website or its underlying systems;
  • using the Website in any manner that misrepresents an association, affiliation, endorsement, or sponsorship relationship with Fingpay, or that could damage Fingpay’s reputation or mislead third parties; and

6.  No Framing Policy

No third party may embed, display, mirror, or reproduce the Website or any part thereof — including any individual page, image, video, or graphical element — within an iframe, frameset, inline frame, or any similar mechanism on another website, application, or digital platform without Fingpay’s prior written consent.

Unauthorised framing of the Website may mislead users as to the origin of the content, interfere with Fingpay’s branding, and constitute a misrepresentation of Fingpay’s affiliation with the framing party. Fingpay reserves the right to deploy technical countermeasures and to pursue all available legal remedies against any party engaging in unauthorised framing.

Requests for written consent to frame the Website must be addressed to info@tapits.in, setting out the identity of the requesting party, the intended purpose, and the specific content proposed to be framed.

 

7.  Linking Policy

7.1  Inbound Links
